End-User License Agreement

1. License grant

AdPath, Inc. grants you a non-exclusive, non-transferable license to install and use BenchStress on up to the number of machines included in your purchase, subject to this Agreement.

2. Authorized use

You may use BenchStress to load-test web servers and applications you own or are explicitly authorized to test. Using BenchStress against systems you do not own and have not been authorized to test may violate computer-fraud laws in your jurisdiction; you assume all responsibility for your use of the software.

3. Prohibited use

You may not use BenchStress to attack, harass, or deny service to any system without authorization. AdPath, Inc. may revoke your license without refund if you misuse the software.

4. Reverse engineering

You may not reverse-engineer, decompile, or disassemble BenchStress except to the extent expressly permitted by applicable law.

5. Updates

For the BenchStress Premium subscription, you receive product updates for as long as your subscription is active. For the BenchStress Lifetime tier (when available), your purchase entitles you to product updates for twelve (12) months from the date of purchase, after which the software continues to function but updates are no longer included.

6. Refunds and cancellation

For BenchStress Premium subscribers, you may cancel any time via the customer portal; the subscription remains active until the end of the prepaid period and is not refunded for the unused portion. We will refund the most recent charge on request within thirty (30) days of payment. Email support@benchstress.com from your purchase email.

7. Warranty & liability

BenchStress is provided “as is” without warranty of any kind. To the maximum extent permitted by law, AdPath, Inc. shall not be liable for any damages arising out of your use of the software.
